House Bill 1144 took effect on May 2nd, 2025 and is considered an “emergency measure” due to its immediate implementation. It prevents K-12 public schools in North Dakota from having all-gender bathrooms. Any multi-stall bathroom must be designated as either a boys’ restroom or a girls’ restroom.
In addition to the boy or girl designation for all K-12 public school bathrooms, so the law requires school staff and teachers from adopting policies that permit students to use preferred gender pronouns or restrooms that do not match their biological sex. What’s more, schools cannot adopt policies about a student’s transgender status without parental consent and must keep parents informed regarding their child’s status.
Lastly, parents can now file a complaint with their school district if they believe their school is not following the law. This complaint can then be elevated to include civil penalties up to $2,500 per violation.
